CCWHC Information Technology and Data Use agreement


Purpose

The CCWHC closed website and National Wildlife Disease Database are for information purposes only. The website and the database are intended for use by CCWHC personnel and CCWHC partner agencies to aid in monitoring, communicating and managing wildlife health related issues in Canada. The information contained within the website and Database is not to be used for personal or commercial gain.


Privacy


The CCWHC is committed to abiding by the Personal Information Protection and Electronic Documents Act (PIPEDA) as well as Federal and Provincial Freedom of Information and Protection of Privacy Acts. Users of the CCWHC National Wildlife Disease Database and closed website agree to comply with the CCWHC Privacy Policy (Annex A). Changes to the CCWHC Privacy Policy may occur without notification. All changes will be reflected in subsequent versions of the privacy policy and on the CCWHC website. It is the responsibility of the user to ensure you are in conformity with the most recent version. All personal information that you, as a user, provide (name, telephone number, email address, etc.) will be used to administer CCWHC website and database accounts only. Your personal information will not be shared without your specific approval.


Accountability


The User is prohibited from giving access to the CCWHC closed website or National Wildlife Disease Database, including the information contained within, to any person not registered with the CCWHC IT department.
The User will not share any information that may be of a confidential nature; this includes, but is not limited to, personal information (name, addresses, email addresses, telephone numbers, etc.) and information of a sensitive nature, for example embargoed results, such as those found within the West Nile Virus, Avian Influenza and Chronic Wasting Disease surveillance programs. The User is to respect jurisdictional boundaries and accountabilities, for example pre-established communications policies and agreements and government agency mandates and responsibilities. Each application must be authorized by a recognized CCWHC representative in order to ensure its authenticity. A “CCWHC representative” would be defined as any permanent staff or faculty that is in a position to affirm the merits of the application in question. The User is responsible for the accuracy and timeliness of the information he/she enters into the National Wildlife Disease Database.


Disclaimer of Warranties/Limitation of Liability


The Canadian Cooperative Wildlife Health Centre, its partner Universities (University of Saskatchewan, University of Guelph, University of Prince Edward Island, University of Montreal, University of Calgary), the Centre for Coastal Health and any college or department of said Universities, and any agent, officer, or employee of them (collectively "the CCWHC"), does not represent or endorse the accuracy or reliability of any of the information or content (collectively "the Information") displayed, contained on, distributed through, or linked, downloaded or accessed from it’s Web site or found within its National Wildlife Disease Database ("the service"), nor the quality of any products, information or other materials displayed, obtained or used by you as a result of the Information in connection with the Service. You hereby acknowledge that any reliance upon any Information shall be at your Sole Risk. The CCWHC reserves the right, in its sole discretion, without any obligation, to make improvements to, or correct any errors or omissions in any part of the Service or the Information. The Information and Service are provided by the CCWHC on an "as is" basis, and the CCWHC expressly disclaims any and all warranties expressed or implied including without limitation any warranties for fitness for a particular purpose with respect to the Information or the Service. In no event shall the CCWHC and any others responsible for creating the Service be liable for any direct, indirect, incidental, punitive or consequential damages whatsoever with respect to the Information and the Service. The CCWHC is not liable for any damage, including damage caused by viruses, to the User’s computer, computer system, or other property, as a result of access or use of the Information and the Service. The CCWHC web site includes “links” to other Internet sites. The CCWHC is not responsible for the content or availability of these sites.


Intellectual Property/Disclosure of Information


The intellectual property in the information contained on the CCWHC closed website and the National Wildlife Disease Database resides with the CCWHC, unless otherwise stipulated and barring other specific agreements. You will not disclose or make public information on the CCWHC closed website or National Wildlife Disease Database unless you have received permission to do so and you acknowledge the source i.e. “The Canadian Cooperative Wildlife Health Centre” and, where appropriate, the author/individual.


Termination


Failure to comply with any part of the User Agreement may result in the termination of your account and corresponding access to the CCWHC closed website and/or the National Wildlife Disease Database without prior notification. All accounts, except those of non-term CCWHC representatives, will expire within one year from the date of establishment or at the closing of the designated period of employment indicated on the account application form. In all circumstances, except that mentioned above, the duration of the account will not be for a period of greater than one year.
Upon termination, all electronic or other materials obtained from the CCWHC closed website or National Wildlife Disease Database must be destroyed. Provisions which, by their nature, must remain in effect beyond the termination of this User Agreement shall survive.
